Commission Terms of Service

To see our info and pricing for commissions you must first look through and agree to our Commission Terms of Service (TOS).  After reviewing and agreeing to our TOS you will be taken to Pricing and the Commission Request form.

We Do Accept

  • Achromatic Works (Black and White/Grayscale)

  • 2-D Work

  • Digital Prints

  • Physical Prints

  • Framed Work

  • Greeting Cards

We Won't Accept

  • Works in Color

  • 3-D Work

  • Animation

  • Fan Art or Works Based or Works Involving Copyrighted Martial Not Owned by The Colored Pencil

  • Sexually Explicit Content

  • Sexist, Raciest, Homophobic, Transphobic or Anything Else We Deem Hateful or Harmful Content

​Commission Requests

  • All commissions begins at $100 plus cost of materials regardless of time, content, and/or scope of commission.

  • Artist does not accept commission requests for the following:

    • Works in Color

    • 3-D Work

    • Animation

    • Fan Art or  Works Based in/and or works involving copyrighted material not owned by Erica Moorehead, The Colored Pencil, and or Color Pencil Comics Ltd.

    • Sexually Explicit Content

    • Sexist, Raciest, Homophobic, Transphobic or anything else we deem hateful or Harmful content by the Artist.

  • Artist does not operate on a “first come first serve” basis. Projects that fit within Artist's budget, current workload, and that are of personal interest are prioritized. Therefore, not all requests may be accepted.

  • Work on commissions  will not start until both the Service Agreement (Complete and Signed) and Payment have been received by Artist.

  • The client will receive WIP a (Work in Progress) at the sketch/concept step only. Client understands this to be the final stage at which to ask for any requests for edits, augments, changes, or updates to the project. Once the WIP has been approved by the client, any further changes will result in a “Revision Fee” of $40 USD per each Revision of Service. After WIP is approved, Revision Requests must be agreed to by Artist. Artist retains the right to deny Revision Requests after the WIP has been approved. 

Payment

  • Payment is due in USD ($).

  • The total and complete Payment must be received complete and in full by Artist before ANY Service is rendered to Client.

  • Payments must be received by Artist  within 48 hours of the execution of this Contract. Failure to do so will result in cancellation of service. 

  • Once Service has started on Commission), refunds are not available. 

  • After service has begun on Work Product a WIP (Work in Progress) will be sent to Client by Artist.

  •  Once Client has approved of WIP there will be additional fees for any revisions the client wishes to make. ANY and ALL further revisions will be a charge of an additional $40 USD per each Revision.

Deadlines

  • Artist does not accept commissions with urgent deadlines. Client understands that barring Default or Breach of the Service Agreement the Artist agrees to deliver services by the same date of the next calendar year of the signed Service Contract. Both Client and Artist understand this to mean that if this contract is signed on May 19, 1989, Services are to be delivered to the Client by May 19, 1990.

  • Client understands that during the Term of the Service Agreement, Artist may work on personal projects, group projects, or  projects for other clients in addition to Client’s Commission (Service).

  • In the event Artist is unable to complete services agreed upon by the Service Agreement (this Contract), barring Force Majeure and/or Service Agreement  is not in Breach or Default, Artist agrees to pay 50% of the initial payment for services rendered to Client.

    • FORCE MAJEURE. If performance of this Contract or any obligation under this Contract is prevented, restricted, or interfered with by causes beyond either party's reasonable control ("Force Majeure"), and if the party unable to carry out its obligations gives the other party prompt written notice of such event, then the obligations of the party invoking this provision shall be suspended to the extent necessary by such event. The term Force Majeure shall include, without limitation, acts of God, plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions, fire, explosion, vandalism, storm or other similar occurrence, orders or acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, or strikes, lock-outs, work stoppages or other labor disputes, or supplier failures. The excused party shall use reasonable efforts under the circumstances to avoid or remove such causes of non-performance and shall proceed to perform with reasonable dispatch whenever such causes are removed or ceased. An act or omission shall be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates. 

Copyright, Ownership, and Public Display

  • Any copyrightable works, ideas, discoveries, inventions, patents, products, or other information (collectively the "Work Product") developed in whole or in part by Artist in connection with the Services will be the exclusive property of Artist. Upon request, Client will execute all documents necessary to confirm or perfect the exclusive ownership of Artist to the Work Product. 

  • Work Product (Commission) is only to be used for personal use. Personal use means use that is not commercial in any way and that this use is for an individual's own consumption or enjoyment.

  • Client understands that ANY other Use or Display of Artist’s work (Copyright, Intellectual Property or Work Product) is not permitted, and would require Client to obtain explicit and written permission from Artist in order to be allowed.
